One who damaged is obligated to pay the victim, Jewish or non-Jewish, for any damage caused

ואם פשיעה בחפץ של עכו"ם חייב לשלם תלוי בדיוקים ברמב"ם ושו"ע, שאם חייב אז בודאי גם במזיק חייב.
בעיקר, בכל תשלומי נזק או דבר אחר, יש ד' אופנים לשער סכום החוב, ונבארם בדוגמא של מי שעשה מחיצה
בין שדותיו לשדה חבירו:
א- ההנאה שקיבל- בציור שלנו, אם אינו מראה לנו שום משמעות שהוא רצה בדבר זה ונהנה ממנה, פטור.
ב- המלאכה הכי זול של עשיית מלאכה זו- כיון שנהנה בבנין המחיצה, צריך לשלם דמי המחיצה, אבל אם הוא
בנה כותל אבנים, אינו צריך לשלם אלא כמחיצה של קנים.
ג- שויות עשיית אותו מלאכה שעשה- אם עשה בנין אבנים, והוא שילם יותר ממחיר הרגיל למלאכה זו, לא
יצטרך לשלם לו אלא כפי השויות של בנין כזה.
ד- ההוצאות ששילם- אם בנה כותל אבנים ושילם יותר ממחיר הרגיל, יצטרך לשלם כל ההוצאות.
. “Damage” is evaluated as the amount it costs the plaintiff to repair the item
[2]ש"ך (שפז, א), ע"פ חזון איש (ב"ק סי' ו, ג). והש"ך כ' דמה ששמין הפחיתה בשוויות החפץ הוא רק בציור
שאינו יכול לתקנו. והש"ך מיירי באדם המזיק, והחזון איש כ"כ לענין כל דבר שאינו עומד למכירה אלא
לתיקון.
ולכאו' הוא הדין אם ממונו הזיק (ע' שו"ע תג, א).
(or the full replacement value, if the damager wants to pay it, or the decrease in value, if the
victim agrees to it). If repairing it requires an undue amount of time and inconvenience,
reimbursement may be required for the trouble of fixing it.
One who damages an item is required to pay the full value of what he damaged, even if there was something his in it which he wouldn’t have expected. However, this is only if one knew he was damaging what he had no right to. If he mistakenly thought that he was doing the right thing and he instead was damaging it, he need not pay for any “hidden” value.
If one parked in a place where he blocks other cars from passing, they are not obligated to pay for any damage they cause in trying to get around him. However, if a driver damaged his own car in the process, the one who parked is not obligated to pay.
One should not gamble or enter a raffle if the other participants are Jews, as it is a question of
stealing

(סי' רז) מקיל, אבל ע"ש אם יש להקל דוקא כשהממון על הדף, ודוקא אם הדף של שניהם.

ובענין מעשה שמוסד צדקה מכרו כרטיסי הגרלה לקבל ספר תורה, ובסוף אמרו שלא רוצים ליתן לו הספר תורה,
ואמרו שהם מסכימים שזה מקח טעות ונתנו לו דמי הכסף הגרלה. נלע"ד שאינם יכולים לעשות כן, כי אם הם
אינם נותנים לו הספ"ת, הרי הם גזלו השוויות של כל הכרטיסי הגרלה שמכרו, וצריכים להחזיר שוויות זה
לכל הקונים (כגון, אם הספ"ת שוה 50,000 שקל, ומכרו אלף כרטיסים, הרי כל כרטיסי שוה 50 שקל וצריכים
להחזיר זה לכל הקונים.]
, but other organizations must advertise that no purchase is necessary in order to win (which they
usually are required to do anyway for legal reasons). A condition should be stipulated that if any
tickets are lost, the owner of the ticket forgoes any right to the ticket
[5]שו"ת חוות יאיר (?), ואם לא עשה כן, הגורל נתבטל

One is obligated to pay for any damage one cause anyone else’s property. However, if one had no reason to expect that object to be there and was not obligated to look first, one is not obligated to pay.
When driving a car in city streets, one is obligated at all times to keep his eyes on the road, and one can never claim he is not liable because “it wasn’t supposed to be there”. If one is pulling out of his driveway and someone left a bike there, he may be exempt from paying, depending on the circumstances.
One may not use someone’s object without permission even if he is a friend who would not mind. However, it is permitted in cases when it is so clear that one would not even think to ask permission, such as a child who enters his parent’s home and helps himself to food.
If one wants to allow the public the right to use his property as a shortcut, it is recommended
that he hang a sign that he still retains ownership, because otherwise he might not be able to
deny them the right to use it

יש לדון:
א- לדעת רשב"ם, צריך שהרבים יתקנו הדרך להילוך כדי לקנותו ולא די בהילוך לבד, והו"ד בב"י בלי שום
חולק. אמנם, ע' פת"ש (שעז, א) דסתימות הפוסקים דלא כרשב"ם, ואפי' לרשב"ם היינו דוקא בחצר שאפשר
לעשות בו שאר תשמישים, אבל אם אינו עומד אלא להילוך, קנאו בהילוך, כמו שקונים שביל של כרמים בהילוך
לבד (ע' שו"ע קצב, ז).
ב- לדעת רמב"ם, לא קנו אלא אם הדרך הוא ט"ז אמות, אבל ע' פת"ש (שם) בשם שו"ת פני יהושע דחה דבריו
מהלכה.
ג- שו"ת מהרש"ם (א, ה) בשם שבו"י (א, קס) כ' דבכל ציור שיש לו "טאבילעציא" [טאבו] שהוא הבעלים, אין
צריך למחות כי הוא סומך על הטאבו, ומסתמא לא מחל נגד השטר.
ד- ועוד יל"ע עפמ"ש חכמ"ש (שם) דדוקא מיצר שהחזיקו בו רוב אנשי העיר, אבל לא אם רק מיעוט החזיקו בו.
[ומשמעות הפוסקים אינו כן.]
ה- וע' חכמ"ש (שם), דבזה"ז הוי דינא דמלכותא דינא ולכן לא שייך דין זה, עכת"ד, ובזה"ז שאי אפשר
לקנות קרקע אלא בשינוי ה-property records אצל הממשלה, ומדינא דמלכותא יתבטל כל שאר קנין שעשו.
[ואין זה כטענת המהרש"ם הנ"ל.] אבל יש לדחות, שאפי' אם בימי חז"ל הקנין היה קנין גמור, בזה"ז לפחות
יש להם זכות השתמשות.
ויש לדון עוד: האם הטענה של הרבים הוא דמסתמא אחד מבני רשות הרבים קנה הרשות ממנו, או הוי חזקה שאין
עמה טענה ואע"פ שאנו יודעים שלא הרשה לשום אדם להשתמש בו ואעפ"כ נעשה של רבים.
ועוד יש לדון בזה, אי אמרינן שהרבים קנאו בקנין גמור כגון כל חזקת קרקעות (כדמשמע פת"ש שם, וכמדומני
דמשמע כן בשו"ע הרב), או רק קנו חזקת תשמישים. ויש נפק"מ אם הרבים יכולים להשתמש בשאר תשמישים שם.
ולכן, הלכה למעשה, יש הרבה צדדים לומר שיכול לקלקל מיצר שהחזיקו בו.

A. Exemptions
There are various cases where one may be exempt from paying for damage to another’s property:
1.
Two people travelling normally.
If two people were walking at a regular pace in a public area and one bumped into the other and
damaged him or his property, or they damaged each other, they are both exempt from paying. The
same is true if both were running
[7]תכא, ח.
. If the one who damaged saw the other person, according to some opinions he should pay, but he is
not obligated to do so
[8]ע' רמ"א (תכא, ח) משמע דדוקא אם הזיק בכונה חייב, אבל בלא כונה, פטור אע"פ שראהו. וע' שו"ע (שעח, ז)
שאם ראו זה את זה, אע"פ שלא כיונו, חייבים. וע' גר"א (שעח, יז) הקשה סתירה בדברי הטור, ולמעשה, לדעת
רש"י, אם ראוהו זה את זה חייבין, ואינו פטור אלא בציור שהוזקו ממילא ולא אם הזיקו, ולדעת רמב"ם פטור
בכל גווני.
ועערה"ש הקשה על דעת השו"ע דסע' ד משמע שאם לא מתכוין להזיק, פטור, וזה סותר מ"ש בסע' ז' דאפי' רק
ראוהו ולא כיוון להזיק, חייב? ויישב דברשות המזיק, פטור אא"כ מתכוון להזיק, ובזה מיירי סע' ד', אבל
ברשות הרבים חייב אפי' רק ראוהו זא"ז.
. If one intentionally bumped into the other, he must pay for any damage caused
[9]שעח, ד
.
A driver who is driving at a normal speed should be careful not to splash through puddles which will spray water on pedestrians, but if he did so, he need not pay. However, if he did so intentionally [10]תכא, ח , or he was speeding faster than most people do [11]תיא, ג, ע"פ סמ"ע שם , he must pay.
2. Illegal Trespasser. If someone entered another person’s land without permission, and the landowner did not notice him and accidentally damaged him or his item, the landowner is exempt from paying [12]שעח, ? .
3. Performing a Mitzvah. In most circumstances, if someone ran fast and knocked into someone walking normally, damaging him or his item, the runner is obligated to pay, because one has no right to run in a manner which may damage others. However, if he was running on Erev Shabbos to prepare for Shabbos, and accidentally caused damage, he is exempt, because the Torah permits running to prepare for Shabbos [13]שעח, ח . This does not apply to one who was running to perform other mitzvos [14]פת"ש (שעח, ד) בשם חוות יאיר (ס' רז), דדוקא רץ ערב שבת משום דבהיל טובא, משא"כ בשאר מצות שאינו בהול כ"כ. . (See the next rule that if one damaged while he was running to save a life, he is exempt [15]ערה"ש (שעח, ט) , but that exempts one from even intentional damage.)
If one lit Chanukah candles which started a fire and damage others’ property, he is obligated to pay, even though he was fulfilling a mitzvah. This is because when one lights in a place which may damage others’ property, he is obligated to stay with the candles to ensure they will not damage [16]תיח, יב. דכיון שיכול לשמור מלהזיק הרי חייב לישמר מזה, משא"כ בציור הקודם, דכשהוא רץ אי אפשר לשמור שלא יזיק, א"כ לא הטילה התורה חיוב עליו לישמר מזה. .
When driving, even on Erev Shabbos, one is obligated to pay for damage he causes with his carelessness, because there is no leniency to drive in an unsafe manner when one may hurt or kill others [17]נשמת אברהם (?) בשם הגרש"ז אוירבאך. {וצריך לבדוק שם אם מיירי גם בחבר הצלה שנוהג להציל נפש, אם חייב כשהזיק חבירו בנכסיו או בגופו.} .
4. Saving a Life. If one must steal or damage in order to save someone else’s life, Chazal exempt him from paying, so that one will not refrain from saving the life [18]שפ, ג . For example, if one must smash a window to free someone trapped in a car or drive over a mailbox to rush to the hospital to save a life, he must do so, and is exempt from paying.
However, if a boat with merchandise on it threatens to capsize, and the sailors throw off one person’s merchandise, all those with merchandise must reimburse him. This is because in truth, all of the merchandise was threatening the lives of those present, and that created an obligation on all of them to throw off some merchandise to save the boat [19]רמ"א (שפ, ד), ע"פ הבנתי בדברי סמ"ע. ואין לומר לפוטרם כדי שלא ימנע המציל מלהציל, דהא הכא בודאי יציל כיון שחייו בסכנה. .
If to save his own life, one has to steal or damage someone else’s property, he is obligated to reimburse the owner [20]שפ, ג .
5. Oness. One is obligated for any damage he causes, but if he was completely unable to stop himself from damaging ( oness gadol), he is exempt [21]רמ"א תכא, ד, וכן מבואר בשו"ע (שעח, ג) ורמ"א לעיל (שעח, ב) .
b. Grama and Garmi
If one intentionally causes indirect damage to another’s property, he should pay
[22]דבכל ציורים של גרמא, חייב בדיני שמים.
. If it was caused unintentionally, he need not pay
[23]לענין גרמא, כ"כ חזו"א (ב"ק סי' ה אות ד)
לענין גרמי, כ"כ ש"ך (שפו, א) כ' שוגג או אונס, פטור, כיון שהוא קנס, אבל לרמב"ן חייב כיון שסובר
שחייב לשלם מעיקר הדין.

Although one should pay for intentional indirect damage, in many cases, it is considered a low-level indirect damage, called grama, and beis din cannot obligate one to pay. If it was a more direct form, it is called garmi, and one may be obligated to pay.
One is not obligated in any of the following cases:
1. If the damage was not definitely going to occur based on his action [24]רמב"ן (דינא דגרמי), ורא"ש (ב"ק ט, יג)
2. If he did not do any action to the item to cause damage, or the damage was not caused immediately, he need not pay [25]רא"ש (ט, יג) . Therefore, if one locked up an animal, causing it to starve, or removed pillows so a falling item will break, opened a door so an animal escaped and caused damage, put poison in front of an animal so it would eat it and die, or gave a fire to a child who then burnt something, he need not pay.
However, in a case where the damage was set into motion immediately, he must pay
[26]רא"ש שם
. Therefore, if he mistakenly ruled that one party must pay money in a financial dispute
[27]ע' שו"ע (כה, א) שאם טעה בדבר הגלוי וידוע ומפורש בפוסקים, הדין חוזר. ואם אי אפשר לחזור, כגון
שטיהר את הטמא, או שהלך הבעל דין למדינת הים, לשו"ע פטור, כיון שלא נתכוין להזיק, ולדעת רמ"א חייב
הדיין להחזיר המעות בכה"ג.
ואם טעה בשיקול הדעת, דהיינו דבר שהוא מחלקת הפוסקים ולא ידע שכבר נתפשט ההוראה כאחד מהם, ע"ש סע'
ב-ג ורמ"א שם.
, or he verified currency is genuine and it turned out to be counterfeit, or told thieves where
the other person’s money is so it was immediately stolen, or decided not to build a fence to
prevent his grapevines from growing into his neighbor’s field and causing them to be
assur
as
kilayim,
the offending party must pay.
3. If the item was only valuable to the owner [28]ע' ש"ך (שפו, יא) בשם רש"ל, וכ"כ רא"ש (ב"ק ט, יג, וע' קצור פסקי הרא"ש שם והגהות פלפולא חריפתא עליו), ולדעת רמב"ן (דינא דגרמי, הו"ד ש"ך שם) חייב. (e.g.; if one stole chametz, and after Pesach, his friend burnt it before he could return it. Possible application: if one bought a unique item from a store which turned out to be completely broken, and then his friend lost the item before he could return it to the store, his friend is not obligated to pay, because the item was valueless to anyone except the owner, who could receive a refund for it)
4. If the item is completely whole and undamaged but he caused it to become unusable unless the owner expends money [29]שפו, א. וגם מהא דמבטל כיסו של חבירו דפטור (כ"כ ירושלמי ?) ; e.g., he kicks his friend’s quarter into a lake, where it is clearly visible, but requires time or expense to obtain it
5. If the damage to the item was caused by one’s thoughts [30]חוץ ממפגל ועושה מלאכה במי חטאת — (no modern application, see below regarding kilayim)
6. If one stole an item, and although the item in the interim became worthless, the damage is not visible, and he now wants to return the useless item (one who stole chametz and then Pesach passed, making it assur to eat [31]שסג, א , or stealing an esrog and then sukkos passed [32]ע' פת"ש (שסג, א) מחלקת בזה, ותלוי במחלקת אחרת, דלדעת שו"ע (והגאונים) אם נפסל מטבע בכל העולם הוי כהיזק ניכר ואינו יכול לומר לו הרי שלך לפניך, אבל לדעת רמ"א (ורא"ש) אפי' פסלו המלך, ונפסלה בכל העולם (ש"ך סק"ה), יכול לומר השל"פ. וה"ה בזה, אי אמרינן דדבר שכל העולם מכירים שאינו שוה כלום הוי כהיזק ניכר כדעת שו"ע, גם אתרוג הוי ניכר, אבל אם כל זמן שאין שינוי בעצמותה לא מיקרי ניכר, באתרוג לא מיקרי היזק ניכר ויכול לומר השל"פ. )
7. If one’s animal damaged it indirectly [33]
8. If the damage is an unusual case, he need not pay [34]ש"ך (שפו, א), וריצב"א (תוס' ב"ב כב:), ודלא כמשמעות רמ"א (סע' ג)
It would follow, based on the above, that if one withheld money entrusted to him, preventing the
owner from using it to make more money, that he would not need to pay, because it is an indirect
damage. However, if the withholder used the money to earn himself money, and the owner can show
that he certainly would have been able to use it to make money, he must reimburse the owner for
the loss of potential gain
[35]רמ"א (רצב, ז), ע"פ ערה"ש (ס"ק כא) משמע שאין לחייב אלא אם הריוח ברור וגם המבטל עצמו הרויח מזה.
וע' ש"ך בשם יש"ש (ב"ק ט, ל) דפטור משום דהוי מבטל כיסו של חבירו, ויש"ש הסביר דפטור משום גרמא.

Another exception: if a worker was hired and in the middle of the job, backs out, and because the work was only partially completed, it caused the owner a loss, the worker must reimburse him [36]רמ"א (שלג, ו), וע' באה"ג ונתיבות שם כתבו משום גרמי. [ולכאו' הוא יוצא מן הכללים הנ"ל, דהא חייב אפי' אין כוונתו להזיק, ואע"פ שלא גרם ההיזק מיד, אלא נפסד לאחר זמן.] .
If Reuven tells Shimon in a monetary dispute, “let’s meet in a faraway city and present our case in front of that Beis Din”, and Shimon flies there but Reuven does not show, Reuven has to reimburse Shimon’s travel expenses [37]רמ"א (יד, ה) . This is because when someone tells someone else to spend money, that creates a monetary obligation on the instructing party to reimburse him if it would cause the other party a loss [38]דהיינו מדין ערב. ובאמת לא שייך כלל לדיני גרמי. .
c. Watching Other’s Items
If one borrows an item, rents it, or is entrusted with watching an item, he must protect it in the way which this item is normally protected.
One is permitted to leave the item in any situation which he thinks the owner would be okay with
[39]דהיינו, לשומרו כדרך השומרים.
. For example, if one borrows a scooter, and in that area it is common to leave scooters outdoors
with absolutely no protection, he is permitted to leave it there. If someone asks Reuven to bring
him a package, Reuven can send the package with a neighbor who he thinks the owner would trust to
bring it
[40]כן נראה לי פשוט, וכן הסכים לי כמה דיינים. ובפרט בזמנינו אם הוא חפץ שעושים לרוב ואינו רוצה דוקא
חפץ זה, ולהיפך אם החפץ נאבד והשומר קונה אחר במקומו בעליו יהיה שמח, ודאי ברוב חפצים יהיה מותר
למסור לשומר אחר, אם הוא ממש שומר טוב.
ודין זה גם נוגע בעוד ציורים, כגון או ראובן ביקש משמעון לקנות לו ספר מן החנות, ולמעשה שמעון לא
הלך לשם אבל שאל לוי לקנות הספר וליתנו לראובן, מבואר בשו"ע (קפג, ד) שמיד כשקנאו החפץ הוא של
ראובן, וא"כ מן הסברא של אין רצוני שיהיה פקדוני ביד אחר לכאו' יהיה אסור לעשות כן, אבל נראה שמעשים
בכל יום שעושים כן, ונראה הטעם כמ"ש.
. (It should be noted however, that if the item would become ruined, the guardian would be
obligated to reimburse the owner, if he had given it to someone who the owner claims he did not
trust.)
If the item breaks while under his watch, whether he has to pay will depend on what type of guardian he is. The general rules are, a borrower is obligated to repair or replace the item, but if it broke during normal use, he is exempt [41]שמ, א . One who is watching the item for free is usually exempt from paying, but if it broke due to his negligence, he must pay [42]רצא, א . One who rents an item [43]שז,א or is paid to watch it [44]שג, ב , is sometimes obligated.

[ואין זה כטענת המהרש"ם הנ"ל.] אבל יש לדחות, שאפי' אם בימי חז"ל הקנין היה קנין גמור, בזה"ז לפחות יש להם זכות השתמשות.
ויש לדון עוד: האם הטענה של הרבים הוא דמסתמא אחד מבני רשות הרבים קנה הרשות ממנו, או הוי חזקה שאין עמה טענה ואע"פ שאנו יודעים שלא הרשה לשום אדם להשתמש בו ואעפ"כ נעשה של רבים.
ועוד יש לדון בזה, אי אמרינן שהרבים קנאו בקנין גמור כגון כל חזקת קרקעות (כדמשמע פת"ש שם, וכמדומני דמשמע כן בשו"ע הרב), או רק קנו חזקת תשמישים. ויש נפק"מ אם הרבים יכולים להשתמש בשאר תשמישים שם.
ולכן, הלכה למעשה, יש הרבה צדדים לומר שיכול לקלקל מיצר שהחזיקו בו.
ועערה"ש הקשה על דעת השו"ע דסע' ד משמע שאם לא מתכוין להזיק, פטור, וזה סותר מ"ש בסע' ז' דאפי' רק ראוהו ולא כיוון להזיק, חייב? ויישב דברשות המזיק, פטור אא"כ מתכוון להזיק, ובזה מיירי סע' ד', אבל ברשות הרבים חייב אפי' רק ראוהו זא"ז.
לענין גרמי, כ"כ ש"ך (שפו, א) כ' שוגג או אונס, פטור, כיון שהוא קנס, אבל לרמב"ן חייב כיון שסובר שחייב לשלם מעיקר הדין.
ואם טעה בשיקול הדעת, דהיינו דבר שהוא מחלקת הפוסקים ולא ידע שכבר נתפשט ההוראה כאחד מהם, ע"ש סע' ב-ג ורמ"א שם.
וע' ש"ך בשם יש"ש (ב"ק ט, ל) דפטור משום דהוי מבטל כיסו של חבירו, ויש"ש הסביר דפטור משום גרמא.
ודין זה גם נוגע בעוד ציורים, כגון או ראובן ביקש משמעון לקנות לו ספר מן החנות, ולמעשה שמעון לא הלך לשם אבל שאל לוי לקנות הספר וליתנו לראובן, מבואר בשו"ע (קפג, ד) שמיד כשקנאו החפץ הוא של ראובן, וא"כ מן הסברא של אין רצוני שיהיה פקדוני ביד אחר לכאו' יהיה אסור לעשות כן, אבל נראה שמעשים בכל יום שעושים כן, ונראה הטעם כמ"ש.
